Under Section 204 of the 2021 Consolidated Appropriations Act (CAA), insurance companies and employer-based health plans must submit information regarding prescription drug benefits and health care spending. The information must be submitted to the Centers for Medicare and Medicaid Services (CMS) by June 1st of each year for the prior year’s coverage.

Annual MLR Employer Survey Deadline and Resources

Blue Shield of California will soon distribute its annual Medical Loss Ratio (MLR) surveys to small business groups (fewer than 150 employees). The deadline to submit information is March 31, 2025.

Employers Must Provide:

• Average number of employees during 2023.
• Whether the business is wholly owned by one individual and spouse.
• Whether they operate a non-ERISA plan (most employers are covered by ERISA).

Employers can submit information online using their Group ID and web key #44n50c or by faxing the completed survey to 855.895.3497. Any rebates determined to be owed will be issued by September 30, 2025.
