Effective immediately, UnitedHealthcare has updated its small group guidelines to enforce California and Federal common law employee requirements. Going forward, similar to other carriers in the market, UnitedHealthcare will no longer accept 1099 contractors as benefit eligible.
With the passage of AB5, many workers previously categorized as independent contractors will now be considered common law employees and as such may qualify for coverage under standard U/W eligibility.
