Blue Shield – SB 729 Fertility Coverage Additional Guidance

The Department of Managed Health Care (DMHC) has issued revised guidance on SB 729, California’s fertility coverage law. Blue Shield of California has stated that the new guidance does not affect plans issued or renewed before July 1, 2027.

What you need to know

  • Revised guidance: DMHC updated All Plan Letter (APL) 25-021 on October 5, 2026.
  • Effective date: The revisions apply to plans issued or renewed on or after July 1, 2027. Plans renewing through June 30, 2027 are not subject to them.
  • 2026 plans: DMHC approved Blue Shield’s fully insured 2026 group plans with fertility coverage in 2025, and the approved benefit changes are already in place.
  • What’s next: Blue Shield is reviewing the new requirements. Any additional benefit changes need DMHC approval, and Blue Shield will update plan documents (Evidence of Coverage and Summary of Benefits) if changes are approved.

What this means for your clients

Groups with Blue Shield plans renewing before July 2027 don’t need to do anything. We’ll share more as Blue Shield finalizes plans for groups renewing on or after July 1, 2027.
